Perkie Terms and Conditions

1. About these Terms
These Terms and Conditions (“Terms”) apply to your access to and use of Perkie’s websites, mobile experiences, services, competitions, rewards, points, and related features (together, the “Platform”).
Perkie is operated by Sell2Cell Limited (“Perkie”, “we”, “us”, “our”). By creating an account, signing in, or using the Platform, you agree to these Terms.
2. Eligibility and Accounts
2.1 You must be legally capable of entering into these Terms and must provide accurate account information.
2.2 If you are under 18 years of age, you must have parent or legal guardian consent to use the Platform and participate in promotions or competitions.
2.3 You are responsible for keeping your login credentials secure and for all activity under your account.
2.4 We may suspend, restrict, or close accounts where we reasonably suspect misuse, fraud, or breach of these Terms.
3. Platform Use
3.1 Perkie is a promotional and rewards platform connecting members with participating businesses and activities.
3.2 You agree not to use the Platform in any unlawful, misleading, abusive, or harmful way, including by creating fake accounts, impersonating others, automating interactions, or attempting unauthorised access.
3.3 We may monitor usage and investigate suspicious activity to protect members and the Platform.
4. Perkie Points and Rewards
4.1 Perkie Points are promotional points and have no cash value.
4.2 Points are not transferable, not redeemable for cash, and are not legal tender.
4.3 Points may be earned through activities such as promotions, referrals, daily engagement, or other Platform participation as we determine from time to time.
4.4 We may amend, pause, or discontinue point-earning and point-redemption rules at any time.
4.5 We may reverse, withhold, or cancel points and rewards if we believe they were obtained through error, abuse, breach of these Terms, or suspicious activity.
5. Competitions and Promotions
5.1 Competitions and promotions on Perkie may have separate specific terms. By entering, you agree to the applicable competition terms in addition to these Terms.
5.2 Entry limits, eligibility criteria, draw methods, and prize conditions may differ by promotion.
5.3 We may disqualify entries that do not comply with applicable terms or that involve fraud, manipulation, or abuse.
6. Business Listings and Third-Party Offers
6.1 The Platform may include participating businesses and third-party offers. We do not control all third-party content and cannot guarantee every offer, listing, or external service.
6.2 Any transaction or interaction between you and a participating business is between you and that business, subject to applicable law.
7. Privacy
Your personal information is handled in accordance with our Privacy Policy and relevant New Zealand privacy law.
8. Intellectual Property
8.1 The Platform, including branding, logos, design, code, and content, is owned by or licensed to Perkie unless stated otherwise.
8.2 You must not copy, modify, distribute, reverse engineer, or commercially exploit Platform materials except as permitted by law or with our written permission.
9. Service Availability and Changes
9.1 We may update, modify, suspend, or discontinue any part of the Platform at any time.
9.2 We do not guarantee uninterrupted or error-free service.
10. Disclaimers
To the extent permitted by law, the Platform is provided on an “as is” and “as available” basis. We do not make warranties of any kind regarding availability, reliability, or suitability for your specific purpose.
11. Limitation of Liability
To the maximum extent permitted by law, Sell2Cell Limited is not liable for indirect, incidental, special, or consequential loss arising from use of the Platform, including loss of profits, data, business opportunity, or goodwill.
Nothing in these Terms excludes rights that cannot be excluded under New Zealand law.
12. Indemnity
You agree to indemnify Perkie and its officers, employees, and contractors against claims, losses, or costs arising from your breach of these Terms or misuse of the Platform.
13. Termination
13.1 You may stop using the Platform at any time.
13.2 We may suspend or terminate access immediately where necessary to protect the Platform, comply with law, or address breaches of these Terms.
13.3 Clauses intended to survive termination (including liability, indemnity, and governing law) remain in force.
14. Changes to these Terms
We may update these Terms from time to time. Updated terms will be published on this page with a revised “Last updated” date. Continued use after updates means you accept the revised Terms.
15. Governing Law
These Terms are governed by the laws of New Zealand. Any dispute is subject to the jurisdiction of New Zealand courts unless otherwise required by law.
